We Are ChangeMakers Website Terms of Use
1. Introduction
1.1 The We Are ChangeMakers (“WACM”) website (the “Website”) is owned and operated by the Southern Alberta Chapter of the Canadian Parks and Wilderness Society (“CPAWS SAB”). The Website is located at www.wearechangemakers.ca. Access to, and use of the Website, including setting up an account or participating in any WACM program (“Programs”), is governed by the terms and conditions provided in these Terms of Use (“Terms”).
1.2 BY ACCESSING AND USING THE WEBSITE, YOU ARE AGREEING TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THESE TERMS.
2. About Us
2.1 ChangeMakers, operated by CPAWS SAB, is an online, inclusive, environmentally-focused community that amplifies the voices and tell the stories of environmental activists of all ages, ethnicities, classes, religions, and other diverse backgrounds and abilities. With hope, everything is possible, especially ecojustice solutions. ChangeMakers seeks to engage and empower nations and neighbourhoods alike. With intentions set on celebrating current nature wins from around the globe and at home, our online community is here to channel and champion ecojustice for all.

3. Registration
3.1 You may visit and browse the Website as an unregistered visitor but you must register for an account (“Account”) to be an active participant in the WACM community.
3.2 If you are under the age of 18, but 13 years of age or older, we strongly encourage you seek parental or guardian (“Your Adult”) permission to use the Website. You should show these Terms to Your Adult and discuss the Terms with them. We reserve the right to refuse access to the Website and/or any other services in the event such permission is not obtained. Your Adult should approve any information that you submit to us through the Website.
3.3 If you are under the age of 13, you may use the Website only with permission from Your Adult and you should not send us any personal information through the Website.
3.4 When you register, you agree to provide accurate and current information about yourself, as required by the registration process, and to promptly update such information in order that it is kept accurate and complete.
3.5 Your Account is personal to you, and you agree to maintain the confidentiality of any passwords or other account identifiers which you choose or are assigned. You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your computer or other electronic devices, and you agree to accept responsibility for all activities that occur under your Account or password.
3.6 You agree to notify us if you think that someone other than you has accessed your Account without your permission or if you lose your username or password.
4. User Conduct
4.1 All users of WACM agree to adhere to our Community Values:
4.2 Whether you have an Account with us or are just browsing the Website, you agree that you will not use the Website:
4.2.1 in any way that breaches any applicable local, national or international law or regulation;
4.2.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
4.2.3 for the purposes of or attempting to harm, bully, harass, intimidate or attempt to harm others in any way;
4.3 You agree not to use your Account to:
4.3.1 post, transmit, link to, or otherwise distribute any materials, information or content constituting, advocating or encouraging conduct that would be harmful or could constitute a criminal offense or give rise to civil liability;
4.3.2 defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including without limitation, rights relating to privacy and publicity;
4.3.3 post, transmit, link to, or otherwise distribute any information, material (including for greater certainty, software) which becomes a virus, cancelbot, trojan horse, or other harmful or disruptive component; and
4.3.4 post, transmit, link to, or otherwise distribute any materials, information or content that infringes any copyright, database right or trademark of any other person.
5. Rights to Your Content
5.1 “Your Content” refers to any information that you post to or upload to the Website.
5.2 You warrant that you own (or are the licensee) of Your Content.
5.3 By uploading or posting Your Content on the Website, you hereby grant us and our affiliates a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to reproduce, modify, adapt and use Your Content in connection with our provision of the Website and/or any of our other services.
5.4 WACM will not reproduce, share, or otherwise utilize any of Your Content, including photos, except in accordance with our Privacy Policy, which can be reviewed here(insert hyperlink to Privacy Policy).
5.5 You agree to indemnify and hold us harmless from and against any and all losses, liabilities, claims, actions or demands, including but without limitation reasonable legal fees resulting from or related to Your Content.
6. Data Collection, Use and Sharing
6.1 We collect Your Content and other information you provide when you use the Website, including when you sign up for your Account and create or share content. We collect information about how you use the Website, such as the types of content you view or engage with; the features you use; the actions you take; the devices through which you are accessing the Website; and the time, frequency and duration of your activities.
6.2 We use the information that we collect to deliver and continually improve the Website and CPAWS SAB programming and services, such as by conducting surveys and research, testing and troubleshooting new features, measuring the Website and CPAWS SAB’s effectiveness, and sending marketing communications.
6.3 From time to time, we may work with third-party partners to assist withdata analysis, evaluation, and program delivery. We may provide statistics, data and insights that help our third-party partners better understand this community’s engagement with the Website and CPAWS SAB.
6.4 In signing up for your Account, you agree to receive regular and ongoing communications from WACM, including but not limited to newsletters, eblasts, and program updates. You can unsubscribe from marketing emails at any time by navigating to the bottom of the email and clicking ‘Unsubscribe’. Please note that you may continue to receive transactional or Program-related communications from us for so long as you are a participant in the Programs.
7. Downloads
7.1 The Website may allow you to download content, including files, images, PDF documents, videos, audio files, or data incorporated therein (collectively, the “Downloadable Content”). The Downloadable Content is licensed to you for your personal and non-commercial use only. You agree to maintain all copyright and other proprietary notices in the Downloadable Content and that WACM retains complete title to the Downloadable Content and all the intellectual property rights therein. All risk associated with the use of, or reliance on, the Downloadable Content rests with you. You further agree that WACM, to the maximum extent permitted by law, makes no warranties regarding the Downloadable Content, and will not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with your use of, or reliance on, the Downloadable Content.
8. Links to Third Parties
8.1 Third parties may provide information displayed on the Website. The third-party information displayed on the Website is not necessarily sponsored, endorsed, recommended, or licensed by WACM. The third parties ought to be contacted directly regarding any inquiries or for more information on their website policies.
8.2 The Website may provide links to other internet sites. WACM has no control over such sites. WACM does not endorse nor is it responsible for, any such sites or the information, material, products or services contained on or accessible through those other internet sites.
9. Intellectual Property Rights
9.1 The materials displayed on or contained within the Website including, without limitation all software, design, text, editorial materials, informational text, photographs, illustrations, images, audio clips, video clips, short features, tools, artwork and other graphic materials, and names, logos, trade-marks and service marks (the “WACM Materials”), are the property of WACM, CPAWS SAB or its licensors and are protected by copyright, trade-mark and other intellectual property laws.
9.2 WACM hereby grants you a personal, non-exclusive, non-assignable and non-transferable license to use and display the WACM Materials for non-commercial and personal use only, provided that you maintain all copyright and other notices contained in such WACM Materials. You agree not to produce, reproduce, modify, publish, create derivative works from, display, perform, translate, distribute, adapt, broadcast, communicate to the public by telecommunication or circulate any WACM Materials to any third party (including, without limitation, the display and distribution of WACM Materials via a third party website) without the express prior written consent of WACM. Unless expressly permitted herein, any use of WACM Materials is only permitted with the express written permission of WACM, CPAWS SAB and/or its licensors. You further agree that you will not disassemble, decompile, reverse engineer or otherwise modify the WACM Materials.
9.3 Nothing contained in the licence granted under these Terms shall be construed as conferring any right under any copyright of WACM or any other person who owns the copyright. All rights reserved. Any reproduction, modification, publication, transmission, transfer, sale, distribution, display or exploitation of the information, in any form or by any means, or its storage in a retrieval system, whether in whole or in part, without the express written permission of WACM is prohibited.
10. Service Availability
10.1 The Website may be unavailable from time to time, or your experience accessing the Website may vary depending on your region or device. We strive to keep the Website up and running; however, all online services suffer occasional disruptions and outages, and WACM is not liable for any disruption or loss you may suffer as a result. In the event of an outage, you may not be able to retrieve your content or data that you have stored. We recommend that you regularly back up your content and data that you store on the Website.
11. Modifications
11.1 WACM reserves the right, in its sole discretion to add to, remove from, modify or otherwise change any part of these Terms, in whole or in part at a time. Except as expressly contemplated herein, changes will be effective when notice of such change is posted on the Website. If any change is not acceptable to you, you must discontinue your use of the Website, including your Account. Your continued use of the Website and your Account after any such changes are posted will constitute acceptance of those changes.
12. Termination
12.1 WACM reserves the right to suspend or terminate your access to the Website, at any time for convenience, or for any other reason, including without limitation if WACM has determined in its sole discretion that the use by your, or of third parties using your passwords or accounts of the Website was in breach of the Terms.
13. Limitation of Liability
13.1 The Website is provided on an “as-is” and “as-available” basis. WACM does not provide any representation, warranty, guarantee or condition that the information accessible via the Website is accurate, error-free, complete, current, or suitable for your intended use. All representations, warranties, guarantees and conditions are hereby disclaimed to the maximum extent permitted by applicable laws.
14. Indemnification
14.1 You agree to indemnify, defend and hold harmless WACM, CPAWS SAB, their affiliates, governing board, officers, agents, employees, partners, funders and suppliers from any liabilities, losses, claims, demands, and expenses (including reasonable lawyer’s fees) related to (a) your use of the Website and your Account; or (b) your violation(s) of these Terms.
15. Governing Law
15.1 These Terms of Use will be governed by the laws of Alberta, Canada, without reference to its conflict of laws principles. Each party hereby agrees to submit to the non-exclusive jurisdiction of the courts of the Province of Alberta and to waive any objections based upon venue.
16 Entire Agreement
16.1 These Terms you have entered into are personal to you, and you may not assign your rights or obligations to anyone. These Terms constitute the entire agreement between you and WACM pertaining to your use of the Website, and supersede any prior agreements between you and WACM relating to the subject matter hereof.
16.2 If any of the provisions (or parts thereof) contained in these Terms are determined to be void, invalid or other unenforceable by a court of competent jurisdiction, such determination will not affect the remaining provisions of parts thereof contained herein.
CPAWS Southern Alberta (SAB) Chapter is committed to safeguarding the personal information entrusted to us by our members, donors, education program participants, and volunteers, and to adopting best practices standards in the evolving area of digital information, data protection and privacy. CPAWS-SAB recognizes that donors, program participants and other stakeholders expect charities and not-for-profits to safeguard their personal information, protect it from misuse and be transparent and accountable for how it is used.
This policy outlines the principles and practices we follow in collecting, using, storing and disposing of personal information.
Personal information means information about an identifiable individual. This includes an individual’s name, home address and telephone number, age, sex, gender, marital and family status, identifying numbers, financial information, health information and education history.
We collect only the personal information that we need for the purposes of providing services to our members, donors and education program participants, administering our volunteer program and administering donations.
CPAWS-SAB collects personal information for the following purposes:
We normally collect personal information directly from the individual in question. We may collect an individual’s personal information from another source where the individual has consented to the collection from the other source, or as authorized by law.
We inform the individual, before or at the time of collecting personal information, of the purposes for which we are collecting the information. The only time we don’t provide this notification is when an individual volunteers information for an obvious purpose.
Consent
We ask for consent to collect, use or disclose personal information, except in specific circumstances where collection, use or disclosure without consent is authorized or required by law. We may assume client consent in circumstances where the client volunteers information for an obvious purpose.
Application to personal information collected prior to the implementation of this policy
We assume client consent to continue to use and, where applicable, disclose personal information that we have already collected, for the purpose for which the information was collected. We will seek consent when we update information that we have already collected.
Using and disclosing personal information
CPAWS-SAB is a chapter organization under the CPAWS umbrella. CPAWS-SAB will share personal information with CPAWS National to the extent necessary to administer donations and engage in fundraising and donor stewardship activities.
We use and disclose personal information only for the purpose for which the information is collected, except as authorized by law. If we wish to disclose personal information for a new purpose, we will ask for consent.
Consent to send email communications
CPAWS-SAB will obtain consent from individuals prior to sending electronic messages for the purposes of promoting a campaign, distributing a newsletter, or advertising an event or contest. An individual may withdraw their consent at any time, and CPAWS-SAB will provide an ‘unsubscribe’ option as part of every electronic communication of this type.
Retention and destruction of information
CPAWS-SAB only retains personal information for so long as the organization reasonably requires the personal information for its charitable purposes, or in compliance with legal requirements. When personal information is no longer required, it is securely destroyed in a manner appropriate to the nature of the record.
Use of electronic waivers
CPAWS-SAB commits to adhere to best practices and applicable legislative requirements in the evolving area of digital information, data protection and privacy.
Where CPAWS-SAB makes use of an electronic waiver, a specific consent must be included in the electronic waiver. Individuals must be advised they have the right to request to sign a paper copy of the waiver instead of using an electronic waiver.
Where CPAWS-SAB makes use of an electronic waiver, CPAWS-SAB will select an electronic waiver platform that provides for: (a) accessibility of records; (b) retention of records that applies with laws applicable to CPAWS-SAB; (c) reliable assurance as to the integrity of the information contained in the record, including the integrity of the signature. Digital signatures provide an extra level of security by using technology that encrypts the signature and ensures the person signing it is who they say they are.
Personal information stored outside Canada
If CPAWS-SAB uses a service provider located outside Canada to collect and store personal information, that service provider has only been authorized to collect, use and store information on behalf of CPAWS-SAB for the purposes of administering CPAWS-SAB’s electronic waiver records, which are used by our education programs. Collection and storage of the electronic waivers used by CPAWS-SAB occurs in the United States.
